When creating an invoice from sales orders the items not in stock dont go to the invoice, which settings need to update?

Please check the invoicing policy in the Sales configuration ("Invoice what is ordered" or "Invoice what is delivered"). If you invoice based on delivery, you'll have to force delivery.
