Re: Plagiarism in the Odoo App Storeby
After a complain about violation of licence I receive this mail so odoo respond and make his job of regulation also if you are not official partner
We noticed your CMMS module on Odoo Apps:
The 6.1 module includes contributions from "Nextma" and "Héonium" as you can see in their README file. Since the license of this module is AGPL and your module is clearly based on it, you must comply with the AGPL license terms and includes "Nextma" and "Héonium" as contributors to the module.
The minimum requirement for this is to state in your module description that it is based on the work of those two people/company. Another way would be to add them in the author list of the module. Either way is okay as far as the AGPL goes.
In addition, you need to restore those two lines in the README file:
Please be careful of the licenses. Open-source means that you can take someone else's work, improve it and distribute your enhanced version of it, but it doesn't mean that you can pretend they never worked on it.
Hi NhomarThe FSF rules are existing since very very long time. When I met Richard Stallman in Bangkok some years ago he made it very clear why the whole FSF movement actually started.GNU's not Unix. It is Free Open Source Software but it's HURD Kernel did never make it to something like the Linux Kernel (which is nonGNU! and now everybody is talking about LINUX and not about GNU LINUX even more than 90 % of the software most of us are using on their servers is GNU, but unfortunately it won't run without a kernel ;-)This shows that you are not alone with your sorrows but you can see also the huge benefit for EVERYBODY, not only the people who created it. I am working since meanwhile more than 2 decades in the Free Open Source Business and I am happy to provide services around that Free Open Source Software we are using to build great applications for customers all around the world in the past years. We contributed a lot and we have got a lot back to. It is a win win situation in most cases with no loosers.Developers, Programmers, Designers, Tutors, Manual writers etc have all their benefits and their things they can't do so good but together they can form a very powerful team and exactly this is happening in the FSF Movement. Everyone is invited to join and none is blocked as long they are following the simple Rules given by those licenses. It does not matter how much time, effort, money you invested to make things happen! It happens much more what you did for the Community of All and they are happy using your modules - things you have created. Be happy about that! You have talents and the will to share your talents and skills with others and you are not one of those reedy ones working only for the benefit of themselves filling up their pockets and showing others "I am rich". You who share with others are much richer than those - believe me! You won't be able to take all monetary richness with you after your livespan, but your know how and skills will always be with you and they will be gone after you are gone unless you start sharing all of it with others, with as many people you can. This will actually multiply your effort and will unite people and it will finally benefit you the most! You will receive Feedbacks, other knowledge parts you did not have but which will help you to create even better things, better tools, better programs. It is a circle of Life which will never end when you are living the FSF idea 100% without intention to close down sources again by changing licenses over and over again from GPL to AGPL to LGPL to have finally more and more Proprietary Code parts which are simply closed down for others!OK if this is the intention you are following do it but than simply use non GPL stuff to make sure your parts can stay proprietary! My point is As community we should help people which try some hard business models selling their modules not allowing other people copying simply and republishing "just because they say thet have they have good intentions", the same for books, papers, campaigns and so on.Well as community we should help also all those which like to start business and can't afford using proprietary stuff or high priced Products. If they have a clever idea how to sell the stuff you have created to even more customers or to other customers than it finally will benefit you to. You only have to copy their business model and learn from them as they learn from them. It is not copying (as this would be 100% legal according to FSF rules - this is why the FSF has been created) no, it is learning from experience, learning from software others have created, learning from business models others are using. Free Open Source Software is not the right place for Greedy people! If somebody decide sell 1 module for 1000 but give me access to the source code under *gpl.. and then because I am "good intentioned" I republish in 200 then, even if I am legally allowed to do that I am failing in 2 stuff:
1.- Plagiarism (even if legal) because I will delete publically (even if not from the code) their authorship.
2.- Stupidity: why not simply hire some hours to the author if the work was well done? (that's what we are trying to do with Odoo). What is the problem with that. Hopefully there is also someone who will integrate all other again and makes the sourcecode again accessible for all others - of course for no fee and you to can benefit from this offer FREE like free beer . But he will do it with FREE like Freedom in mind as his intention is perhaps a bit different. While you want to sell stuff for good money his intention is to make knowledge accessible for everybody, like from UNESCO promoted - All inclusive Education for All. You can read more about it from a workshop I participated here Regional Workshop on Inclusive Education on Getting all ....This workshop and the many talks to other participants from all around the world changed my live and intentions - I would say purpose of life - a lot! There is so much more than only focussing on money! You are not failing and you are not stupid by the way, but you need to refocus perhaps for your purpose of life!that's one of the reason all pure FSF software complaiant simply do not advancewell it seems you did not have a real look in what is going on in that FLOSS Movement. It is more advancing than any other software! and it will even more after the debacle of proprietary software in Volkswagen vehicles and for sure in Billions of other vehicles from other companies too. It will be discovered sooner or later - waiting only for the one decompiling their software parts! - In IRAN afaik and I was told it would be even legal doing that!Yes your example with the marihuana guys is correct. Think back what they did - they simply moved to other places where they did not had to deal with legal problems while smoking marihuana. You need to start thinking more globally as the internet is not a local thing. You simply can't stop anybody in using, renaming, copying, distributing, using, ... your parts of software. There will be always a region in the world where he could do this legally! Even with proprietary software! But you can start teaching how to create those modules you have created. You can start sharing your knowhow instead of complaining that your modules get shared and sold by others for much more profit than you have been able to do in the past. Share your know how - teach others in how to create such great things you do and charge them for that! ;-)To copy a great teacher is nearly impossible! and beside that he will stay in the memory of many people even after his lifespan has ended and the software created by people he has taught in how to create such great stuff will still be running!Have you see The Bucket List? If not try and get that film and make your own Bucket List! and than work on that!Simply change like Jerry Mcguire from the blinded money only site to the site of humanity! You will be very successful! Sure!"Help me help you!" (Jerry Mcguire")"Start before you kick the bucket" (from The Bucket List)If I am the father of the Open Source it was done by artificial insemination with stolen sperm. I am not a supporter of open source. I do not agree with the basic values of open source. I do not try to participate in open source activities. And when anyone refers to my work with that term I take offence. You really shouldn't have done that. You should have known better. ... So the sentry is that most people think they are very familiar with my work and what they think my work is, is something I don't even agree with! Completely wrong. I founded the Free Software Movement. A Movement for computer users Freedom to control you own computing, Freedom to cooperate with other people! These are Freedoms I believe every computer is entitled to and that must never be taken away. It should be in inalianable rights for the user of software. That is the idea of the Free Software Movement! Non free software Proprietary software keeps users divided in helpless. Divided because they are forbidden to share with anyone else, Helpless because they don't have the source code, they can't control what the software does, in fact they are in the mercy of the developer who does control it. So a non free program functions as an instrument of the power of its developer. Power over the users. This is an untrust social system I wish to wipe out from the world. That is the aim of the free software movement in order for every user to have freedom that means there must be no freedom denying software. ...(Richard Stallman)Have a nice day!AndiOn Thu, Nov 5, 2015 at 11:34 PM, Nhomar Hernández <email@example.com> wrote:2015-11-04 23:37 GMT-05:00 Andreas Becker <firstname.lastname@example.org>:Dear Nhomar if you don't like those principals than you are free to choose another business model than the one of Free Open Source Software!Plagarism is something very different!@andrea becker<sarcasm>Yes I will </sarcasm>.When you put your work of more of 3 years freely available (https://www.odoo.com/apps/contributors/modules/) and set another bunch of work mantainable investing all a team on that to be sure everything runs perfect (https://runbot2.vauxoo.com) then you can invite people to do that.My point is not related to ilegal or not ilegal (i.e: it is legal smoke matijuana in some countries it does not mean you MUST decide be addict, and it does not mean If you do it you are 'the good guy of the block' or you should move to another country if you live there, or that I will make my business around that simply because it is "legal").My point is As community we should help people which try some hard business models selling their modules not allowing other people copying simply and republishing "just because they say thet have they have good intentions", the same for books, papers, campaigns and so on.I am talking about communitary stuff not legal bored stuff (that's one of the reason all pure FSF software complaiant simply do not advance) I am talking about specific cumunitary work.If somebody decide sell 1 module for 1000 but give me access to the source code under *gpl.. and then because I am "good intentioned" I republish in 200 then, even if I am legally allowed to do that I am failing in 2 stuff:1.- Plagiarism (even if legal) because I will delete publically (even if not from the code) their authorship.2.- Stupidity: why not simply hire some hours to the author if the work was well done? If I need put my money there then... let's think and find another model because I am 'good willing' :-s" << failNOTE: may be I misunderstood your example and/or you misunderstood my point but I hope it clarify my specific vision.NOTE2: I am clear every case ned to be understood case by case, there are cases where there is not other option than the fork and the republished work, but this is not the "generic" case I am talking about, that's why the **gpl exists and you are right in all legal stuf you mentioned.NOTE3: Thanks for bring all the clarification here and your time expended answering.Regards.
