I'm not suggesting porting Enterprise features to community, just
porting community (v8) features to community (v9).

I agree there is some legal risk in there, especially if people who have
access to the Enterprise source code write this, but I think the risk is
quite limited in the specific cases mentionned in the thread.

In case Odoo is acquired by an Oracle like entity, we will get an Oracle
like outcome, i.e. a clear fork, starting from the latest FLOSS version.
